Meeting
October 7, 2004

Peg Arguimbau Chairman, Katherine Roth, Stephen Cremer and Hank Langstroth were the members present.

7:45 p.m.:  N.O.I. Public Hearing - A.G.M. Inc.  Proposed site preparation for construction of a  single-family residence at Lot 1 Chippewa Road:
Brian Shaheen, Representative from Miller Engineering appeared before the Commission and submitted the green abutter cards.  Brian presented proposed sewage disposal system plan dated 8/30/04 to the Commission. The construction for the proposed project slightly encroaches on the edge of the 100' Buffer Zone in the back portion of the property. No grading is proposed beyond the 100' Buffer Line.
Stephen Cremer expressed his concern regarding a possible negative impact to the vernal pool caused by excess roof water runoff.
The Commission recommended the following:
To present a revised plan showing the location of the original Conservation Restriction Line determined by the Commission. The Conservation Restriction Line is recorded on a previously submitted subdivision plan.
To mark the boundaries of the existing Conservation Restriction Line on the property with orange painted 3' pipes.
The haybale line defined on the submitted plan to establish the limit of work.
The Applicant shall proceed with the removal of the shed located on the back portion of the property in the least intrusive manner to the wetland resource areas on the site.
The Order of Conditions to state that the future homeowner of the property is requested to arrange a meeting with the Commission to discuss the existing Conservation Restriction on the site.
Peg called for a motion to continue the Hearing until October 21, 2004 at 7:45 p.m.
Hank Langstroth moved. Katherine Roth seconded. Voted. Unanimous.

8:00 p.m., N.O.I. Hearing Continuance- Hunter's Ridge States. Filed by Charles & Nick Mirrione of Mirrione Realty Trust for the proposed construction of a residential subdivision roadway and associated appurtenances and stormwater management at 155-157 North Main Street. DEP # SE-280-455:
No Quorum
Katherine Roth recused herself from the Hearing, as she is an abutter to the proposed project.

Scott Faria, Engineer from Gallagher Engineering appeared before the Commission and reviewed the proposed project:
The lot layout for the proposed project has been revised in an effort to increase the amount of open space. The width of the lots has been reduced to 46'. (Approximately 54% of available open space is proposed for the project.)
No changes are proposed regarding the construction of the subdivision roadway and grade work.
Extensive clearing of trees is proposed along the roadway.
A botanist from LEC Environmental is performing a Buffer Zone Enhancement Plan to address the impact on the wetlands from the proposed removal of the trees.
In an effort to reduce the amount of work inside the 100' Buffer Zone, one of the three proposed detention basins has been relocated to the rear of the proposed clubhouse. This detention basin would discharge to a drainage swale before emptying into a sloped area at the eastern section of the property.
A retaining wall, 11' high by 10' wide, is proposed to protect the wetland area in the rear of the property.
Joworski Geotech, Inc. is performing a hydrogeologic study and groundwater mounding analysis of the site. The study is to include a review of the impact to the adjacent properties and existing wetlands from the proposed three detention basins and two common septic systems.
The Commission expressed their concern regarding the possible negative impact to the sloped area in the eastern portion of the property due to the proposed detention basin at the back of the clubhouse.

Greg to contact the Town Engineer to discuss his review of the proposed drainage plan.
In the event that the Town Engineer cannot address all of the drainage issues, the Commission would consider requesting that one person be selected to perform a Peer Review for all of the Town Boards.
Abutter Wayne Godlin, 49 Lantern Lane- expressed his concern regarding the possibility of the proposed project creating more of a significant impervious area than the design of the previous Developer, (Can-Four). Wayne was also concerned regarding the impact to the isolated wetlands as well as potential flooding of the abutting properties due to the removal of the trees.
Peg responded that those issues would be addressed as part of the proposed Peer Review.
Scott Faria explained that by following the DEP stormwater management guidelines for the proposed project the wetlands would be protected.
The Commission agreed to continue the Hearing until October 21, 2004, at 8:00 p.m.

8:45 p.m.: Herb Chambers of Sharon, LLC, met with the Commission to discuss the final drainage
      plan for the proposed redevelopment of an existing gravel pit as a full service auto  
      dealership at 15 & 55 General Edwards Highway. DEP # SE -280-454:

Rick Merrikin, an Engineer from American Engineering represented the Applicant and reviewed the final drainage plan dated 9/2/04 and revised site plan dated 9/20/04 with the Commission.
Attorney Joel Fishman was also present and submitted a letter regarding the Applicant's request to appear before the Commission.
Rick explained to the Commission that the minimum time of concentration on the final drainage calculation plan has been revised to be at least 5 minutes as requested by the Town Engineer. A detail of stormceptor bypass piping is also included on the proposed drainage plan.
Atty. Fishman reviewed a consultant's summary report from the ESS, Group, Inc. regarding the proposed drainage plan. The report indicates that there would not be an increase in the stormwater runoff to the down gradient wetlands at the Walpole Country Club from the proposed stormwater modeling calculations.
The Applicant presented to the Commission a draft of the Order of Conditions and Special Conditions for the proposed project.
The Commission recommended the following:
That the filling operation be monitored during construction to insure the protection of the wetland resources areas on the proposed project site.
A monthly report regarding the progress of the filling operation, with special interest in the areas around the infiltration systems, be submitted to the Commission. At the completion of the filling operation, the Conservation Administrator is to be contacted for a joint site visit.
With the completion of Hank Langstroth's approval of the final drainage calculation plan submitted by the Applicant, Peg called for a motion to close the hearing.
Stephen Cremer moved. Katherine Roth seconded. Voted. Unanimous.
The Commission reviewed the draft of the Order of Conditions and Special Conditions proposed by the Applicant. In response to a time sensitivity issue, the members of the Commission re-worded the contents and agreed to incorporate the corrections as discussed.
Peg called for a motion to issue the Order of Conditions to the Applicant.
Katherine Roth moved. Stephen Cremer seconded. Voted. Unanimous.

9:15 p.m., Release of the Commission's Restriction on Parcel S:
Peg opened the Hearing and read aloud to the Commission, a document proposed by Town Counsel to  release the Conservation Restriction on Parcel "S". Peg called for a motion to release the Conservation    
 Restriction on said Parcel "S". Katherine Roth moved. Stephen Cremer seconded. Voted. Unanimous.

9:25 p.m., Signatures:
The Commission signed bills. The Commission signed a document conveying the Parcel "S" deed toSharon Investment Partners, LLC.
